1. Agreement to Terms

By accessing or using the website seog.pl (the "Site") and services provided by SEOG Poland ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

2. Description of Services

SEOG Poland provides the following categories of services:
  • Software Development — web applications, mobile apps, AI/LLM integration, blockchain development, DevOps, and related IT services
  • Social Media & Marketing — video production, campaign management, profile optimization, and consulting
  • Outdoor Recreation — equipment rentals (kayaks, bicycles, scooters) and camping spot reservations
  • Other IT Services — hosting, web portals, games & entertainment, security consulting
Specific terms for individual services will be provided in separate service agreements or contracts.

3. Use of the Website

You agree to use the Site only for lawful purposes. You must not:
  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Use automated tools to scrape, crawl, or extract data without authorization
  • Transmit malicious code, viruses, or harmful materials
  • Interfere with or disrupt the Site's operation
  • Impersonate any person or entity

4. Intellectual Property

All content on the Site — including text, graphics, logos, code, and design — is the property of SEOG Poland or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
For software development projects: intellectual property rights in delivered work will be assigned to the client upon full payment, unless otherwise specified in the service agreement.

5. Service Agreements

Specific services (software development, marketing campaigns, etc.) are governed by individual service agreements that include:
  • Scope of work and deliverables
  • Timeline and milestones
  • Pricing and payment terms
  • Intellectual property assignment
  • Confidentiality obligations
  • Service-level agreements (where applicable)
In case of conflict between these Terms and a specific service agreement, the service agreement prevails.

6. Equipment Rental Terms

For recreation equipment rentals (kayaks, bicycles, etc.):
  • Renters must be at least 18 years old (or accompanied by a responsible adult)
  • Equipment must be returned in the condition received, subject to normal wear
  • Renters are responsible for damage beyond normal wear and tear
  • Safety instructions must be followed at all times
  • We are not liable for injuries resulting from improper use of equipment
  • Reservations may be cancelled up to 24 hours before the rental period

7. Payments

Payment terms for services are specified in individual service agreements. General terms:
  • All prices are quoted in EUR or PLN unless otherwise specified
  • Invoices are payable within the timeframe stated on the invoice
  • Late payments may incur statutory interest under Polish law
  • We reserve the right to suspend services for overdue payments

8. Limitation of Liability

To the maximum extent permitted by applicable law:
  • Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for loss of data, profits, revenue, or business opportunities
  • The Site is provided "as is" without warranties of any kind regarding availability or accuracy
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless SEOG Poland from and against any claims, losses, damages, liabilities, and expenses arising from your use of the Site or services, your violation of these Terms, or your violation of any rights of a third party.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.
For EU consumers: you retain any mandatory consumer protection rights under the laws of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Any disputes shall be resolved first through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Zielona Góra, Poland, except where EU consumer law provides otherwise.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Site after modifications constitutes acceptance of the updated Terms. Material changes will be communicated through the Site.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original.
